Hanoi City has issued a Regulation on compensation, support, and resettlement when the State revokes land. The Regulation applies to state agencies responsible for land ownership; units tasked with compensation, support, and resettlement; land-using individuals and asset owners attached to the land; and other parties involved in compensation, support, and resettlement when the State revokes land.
Under the Regulation, compensation for land when the State revokes land in Hanoi is generally paid in cash.
Households, individuals, and overseas Vietnamese citizens using residential land and owning houses attached to that land in the city may receive compensation in the form of land use rights and payment of land-use fees, or the sale of housing in resettlement housing, if they meet the conditions specified in the Regulation.
These conditions include cases where all residential land is revoked, or where the remaining residential land after revocation is smaller than the local minimum area for subdivision. The household or individual must also have no other land or housing in the commune/ward where the revoked land is located.
During implementation, the commune-level People’s Committee is responsible for organizing compensation, support, and resettlement in accordance with the law. It must coordinate with the unit performing compensation, support, and resettlement and with mass organizations to publicly inform and persuade affected people to comply with the State’s land-recovery decision.

The Regulation takes effect from 2 April 2026. It replaces Hanoi City’s previous decisions: Decision No. 47/2016/QĐ-UBND dated 8 November 2016; No. 56/2024/QĐ-UBND dated 6 September 2024; No. 38/2025/QĐ-UBND dated 30 June 2025; and No. 10/2026/QĐ-UBND dated 18 January 2026.
