According to Clause 1, Article 78 of the Administrative Violations Handling Law No. 15/2012/QH13 as amended by Law No. 67/2020/QH14 and Law No. 88/2025/QH15, within the time limit for enforcing a penalty decision as prescribed in Clause 2 of Article 68 or Clause 2 of Article 79 of this Law, individuals or organizations subject to penalties must pay the penalty at the State Treasury or into the State Treasury account indicated in the penalty decision, unless they have already paid in accordance with Clause 2 of this Article (Article 78). If the above deadline is exceeded, enforcement of the penalty decision will be carried out and for each day of late payment the violator must pay an additional 0.05% calculated on the total unpaid amount. The following explains the enforcement periods: According to Clause 2, Article 68, the enforcement period is 10 days from the date the penalty decision is received; if the penalty decision specifies a longer enforcement period, that period applies. According to Clause 2, Article 79, the period for paying the penalty in installments is not more than 6 months from the date the penalty decision takes effect; the maximum number of payments is 3. The first payment must be at least 40% of the total penalty. Additionally, Clause 2, Article 78 provides that in remote areas, border regions, and mountainous areas where travel is difficult, the violator may pay the penalty to the competent authority. The person authorized to impose penalties is responsible for collecting the penalty on the spot and paying it to the State Treasury or into the State Treasury account within no more than 7 days from the date of collection. In cases of penalties on the sea or outside business hours, the penalty-imposing authority may collect the payment directly and must pay to the State Treasury within 2 working days from the date of reaching shore or the date of collection.
