The Vice Chairman of Nghệ An Province People’s Committee, Phùng Thành Vinh, has signed Decision No. 16/2026/QĐ-UBND, issuing the Regulation on the management of industrial clusters in the province.
Under the regulation, the area of an industrial cluster must not exceed 75 hectares and must not be less than 10 hectares. For mountainous areas and craft villages, the minimum area is adjusted down to 5 hectares to reflect local conditions.
The development of industrial clusters must be linked to forecasts of manufacturing space demand, available land resources, and labor demand at each planning stage.
The regulation sets strict criteria for the establishment of new industrial clusters. A cluster will be considered only if it is included in the integrated industrial cluster development plan within the province’s approved planning scheme and has land resources compatible with related plans.
For areas that already have industrial clusters, new cluster establishment must meet at least one of the following conditions: the average occupancy rate exceeds 50%, or the total unleased industrial land fund does not exceed 100 hectares.
Where a cluster covers multiple communes, the occupancy and unleased land criteria are calculated separately for each locality, based on the approved detailed planning.
Expansion of industrial clusters is also subject to limits. The total area after expansion must not exceed 75 hectares and must be consistent with related planning.
The industrial cluster development plan may be adjusted when there are changes in land resources to meet demand for land leasing for production and business activities, while ensuring efficient infrastructure investment and the clusters’ actual exploitation capacity.
The regulation clarifies governance responsibilities. The Nghệ An Department of Industry and Trade is responsible for leading the drafting, revision, and supplementation of mechanisms and policies, and for compiling and finalizing the provincial industrial cluster development plan.
Commune-level authorities are tasked with reviewing and proposing development plans and coordinating in filing for the establishment or expansion of industrial clusters as required.
For selecting investors to build infrastructure, the Department of Industry and Trade will advise the formation of an Evaluation Council, which will serve as the basis for the provincial People’s Committee to consider and decide.
The regulation also specifies that related content on adjustments, repealing establishment decisions, drafting, appraisal, and approval of detailed planning, and approving infrastructure investment projects will follow a clear lead and unified implementation.
It further clarifies regulations relating to the environment, land, fire safety, management of public services, production and business activities, inspection, and the building of a database to improve the effectiveness of state governance.
Decision No. 16/2026/QĐ-UBND takes effect from May 1, 2026, and replaces Decision No. 30/2018/QĐ-UBND.
