From July 1, 2026, the approval of advertising content for health supplements will shift from the Food Safety Department of the Ministry of Health to the chair of the provincial People’s Committee. The change is set out in Government Resolution No. 21/2026/NQ-CP dated April 29, 2026, which focuses on reducing and simplifying business conditions and administrative procedures and decentralizing authority for administrative procedures in the health sector.
The approval of advertising content for health supplements is regulated in Clause 5, Article 27 of Decree No. 15/2018/ND-CP, which details the implementation of several provisions of the Law on Food Safety. Under Decree 15/2018/ND-CP, from July 1, the authority to approve advertising content will be exercised by the Chairman of the Provincial People’s Committee.
Under Decree No. 15/2018/ND-CP, organizations and individuals that want to advertise products must submit a registration dossier for advertising content approval to the agency that issues the product registration certificate.
Within 10 working days from the date the agency receives a valid dossier, the receiving agency must review the dossier and return results in the form prescribed by the Decree. The timeline is calculated as follows:
If the receiving agency disagrees with the proposed advertising content, or requests modifications or additional information, it must issue a written statement specifying the reasons and legal basis. The receiving agency may request modifications or supplementation only once.
Within 10 working days from the date the modified or supplemented dossier is received, the receiving agency must appraise the dossier and issue a written response.
After 90 working days from the date of the written request to modify or supplement, if the organization or individual does not make changes, the dossier loses value.
Agencies receiving applications for advertising content approval are required to publicly announce the name and product of the organization or individual that has been granted Advertising Content Approval for health food products. The information must be posted on the agency’s website and in the food safety database.
According to the head of the Food Safety Department, localizing this approval content is intended to facilitate business procedures for enterprises.
The Ministry of Health and related agencies will strengthen post-audit checks on compliance with advertising regulations, including reviewing advertising of health foods on media, social networks, e-commerce platforms, and online marketplaces.
