Two months after the Supreme Court rejected many of President Donald Trump’s tariffs under the International Emergency Economic Powers Act (IEEPA), American businesses can file for refunds. U.S. importers now may be eligible to receive $166 billion in refunds including interest. They began submitting claims on April 20 through CBP’s new portal. CBP estimates refunds will be paid within 60-90 days from application approval, though processing times could extend if filings require additional review. On February 20, the U.S. Supreme Court rejected Trump’s tariff policies under IEEPA, including retaliatory tariffs and unilateral measures against Mexico, Canada, and China. Those tariffs have been halted since February 24. CBP’s refund program, CAPE, is described as designed to consolidate refunds under IEEPA, including interest, rather than processing per shipment, according to a CBP notice. Only entities identified as the official importer of record who have paid the duty, or a licensed customs broker, may apply for refunds. However, not all duties are eligible to apply on day one, April 20. This is only the initial phase of the program. It remains unclear when the system will open for all eligible refunds. The process could take longer if the Trump administration takes further steps to delay or reduce the scale of refunds. "There are other legal mechanisms that could significantly reduce this number," said Kevin Hassett, White House economic adviser, in a recent interview with Fox News. Hà Thu (via CNN, Reuters)
