On April 11, the Hanoi People’s Prosecutor’s Office completed the indictment against 10 defendants in a fraud case involving thousands of investors linked to Bankland Joint Stock Company (Bankland).
The defendants include Vu Duc Tinh (born 1981, residing in Cat Lái Ward, Ho Chi Minh City) and nine others, all indicted for fraud.
According to the indictment, from October 2021 to November 2022, Vu Duc Tinh directed the establishment of three legal entities: Bankland Company, CFAIHO Investment Trading Technology Joint Stock Company (Cawiho), and GBF Group Joint Stock Company (GBF).
The indictment states that these three companies conducted no real production or business activities and instead operated as a multi-level marketing scheme. Funds were raised from investors to pay interest to earlier investors.
Although Tinh was not listed as a shareholder, he claimed to be a senior adviser and directed the operations of all three companies. After the companies were formed, he instructed the chairmen and CEOs to organize conferences and seminars, disseminating false information about investment types to attract cooperation and capital.
Bankland drafted numerous contracts with investors covering areas including real estate, tourism, design consulting, construction, import-export, automobile trading, and technology products. The indictment says the contracts effectively involved uncollateralized fundraising, with promised daily interest rates equivalent to up to 43.2% per year.
The defendants also issued promotional notices featuring gifts such as gold, land titles, cars, motorbikes, iPhones, or overseas trips to generate publicity and draw in more investors.
The indictment states that employees and investors were paid salaries, bonuses, and interest only from March 2022 to May 2022. From June 2022 to October 2022, they no longer received the promised payments.
The indictment details alleged embezzlement at each company:
From December 2021 to September 2022, defendants Vu Duc Tinh, Nguyen Thi Như, Quan Van Dương, Nguyen Thi Thanh Van, Nguyen Duc Minh, Nguyen Van Minh, and Nguyen Thi Thanh Van allegedly embezzled a total of 479 billion VND from 5,291 victims through high-interest fundraising, unlisted stock sales, and selling non-existent projects.
At Cawiho, defendants Vu Duc Tinh, Ta Van Cuong, Ninh Dai Duong, and Nguyen Thi Thanh Van allegedly embezzled a total of 88 billion VND from 59 victims.
At GBF, defendants Vu Duc Tinh, Vu Hong Quan, Kieu Van Hoach, and Nguyen Thi Thanh Van allegedly embezzled a total of 4 billion VND from 18 victims.
The court identified Vu Duc Tinh as the person who directed the establishment and operation of the three companies.
