Asset Viet Nam has reiterated that there has been no transfer transaction involving the chagee.vn domain to CHAGEE. On May 8, the company stated that the domain is still managed by Asset Viet Nam and that no transfer transaction has taken place.
According to Asset Viet Nam, there has been no signed agreement document, no payment has been made, and the domain has not been used in any commercial activity since its registration.
Earlier, on May 7, Asset Viet Nam said it sent a mediation email to CHAGEE’s legal representative, proposing to transfer the chagee.vn domain free of charge.
The company said the proposal aligns with Government Directive No. 38 from the Prime Minister on strengthening protection of intellectual property rights and improving the investment environment.
Asset Viet Nam also emphasized that the transfer proposal does not constitute an admission of any violation. The company said it maintains all legal positions related to the matter and described the proposal as a “final good-faith gesture” that could be considered in discussions with CHAGEE.
Asset Viet Nam rebutted accusations that it had misrepresented CHAGEE’s good-faith intentions. The company pointed to wording from CHAGEE’s public letter, saying that CHAGEE’s “constructive dialogue efforts” were misunderstood.
Regarding CHAGEE.vn’s website operations, Asset Viet Nam stated that it does not use CHAGEE’s logo, typography, or products.
The company said the website interface was created using AI tools, that all contact forms direct users to Asset Viet Nam, and that the site displays domain management rights to avoid user confusion.
Asset Viet Nam further explained that the term “Chagee Viet Nam” is an internal convention applied to the entire domain system under its management, using the structure “[domain] + Viet Nam.” The company said this is not intended to impersonate or misrepresent the CHAGEE brand.
Asset Viet Nam cited Article 75 of the Intellectual Property Law to argue that there is not yet an official decision recognizing CHAGEE as a “well-known brand” in Vietnam.
At the same time, the company said it does not deny CHAGEE’s trademark rights registered through the Madrid system, but it maintains that trademark rights and domain name rights are legally separate issues.
Under Asset Viet Nam’s position, the domain chagee.vn was registered according to the “first-registered, first-granted” principle under the 2023 Telecommunication Law.
The company added that the website has no actual commercial activity, does not use CHAGEE’s branding identity, and is not intended to mislead consumers.
