Over the past period, anti-government groups have distorted the proposal to expand the authority to impose penalties, leading some people to misunderstand that the State is increasing penalties. This has triggered public anger.
The draft amendment has been misrepresented by conflating two separate ideas: “on-site penalty authority” and the “penalty amount.”
According to the clarification, the draft amendment does not propose increasing monetary penalties by 15 times, as some narratives claim. Instead, it refers to raising the on-site penalty authority of the traffic police from 500,000 VND to a maximum of 7.5 million VND.
In this context, fines are the monetary amounts violators must pay, determined by each offense in the decree. By contrast, on-site penalty authority is the maximum amount a traffic police officer may directly impose on the spot, without escalating the case upward.
The proposal to raise on-site authority is presented as a measure to improve enforcement effectiveness, not to increase penalties by 15 times. The content notes that many offenses already carry penalties higher than 500,000 VND. Previously, traffic police officers did not have authority to handle these cases on the spot and had to transfer them upward, which could cause delays.
On-site processing, the clarification says, helps reduce administrative procedures, saves time for both citizens and authorities, strengthens deterrence and traffic discipline, and ensures violations are addressed promptly—avoiding situations described as “soft-on-the-law.”
It also states that penalties have been adjusted upward for many dangerous offenses, and therefore on-site authority should be compatible with the updated penalty framework.
The Phu Tho Provincial Police urged citizens to be cautious about misinformation, rely only on information from official sources, understand the policy’s true nature, avoid sensational headlines, and refrain from sharing unverified information.
The revision of Decree 168 is described as aiming to完善 (improve) the governance mechanism and enhance the effectiveness of enforcing traffic order and safety, and it is not intended to increase penalties by 15 times as distorted claims assert.
