The Prime Minister issued Decision 738/QĐ-TTg to terminate the effect of Decision 893/QĐ-TTg dated July 26, 2023, which approved the National Master Plan on energy development for the period 2021-2030 with a vision to 2050. The move has attracted attention in the energy sector as it clarifies the legal basis affecting investment, production, and business activities.
Officials from the Department of Oil and Gas (Ministry of Industry and Trade) said Law No. 112/2025/QH15 (the Law on Planning), enacted on December 10, 2025, introduced a major administrative reform by decentralizing and delegating authority. Under this framework, the authority to approve adjustments to national sector plans was transferred from the Prime Minister to the ministers responsible for their respective sectors.
Accordingly, on February 28, 2026, the Minister of Industry and Trade issued Decision 363/QĐ-BCT approving the adjustment of the National Energy Plan.
Under the Law on the Issuance of Legal Normative Documents, a ministerial-level document cannot replace the content of a Prime Minister-approved document. Therefore, terminating the effect of the National Energy Master Plan issued under Decision 893 is necessary to avoid overlaps with earlier approved sector plans. Decision 738/QĐ-TTg is intended to confirm that Decision 363/QĐ-BCT becomes the sole legal basis for implementing the energy plan adjustment.
The government said the major objectives—ensuring national energy security, promoting sustainable energy development, and accelerating the energy transition toward green and clean energy—remain intact and will be implemented consistently.
The ministry added that the decision is expected to improve transparency, remove textual overlaps, and create a clearer legal environment for localities and businesses. It also reflects a reform direction toward decentralization and delegation to the ministry level, aiming to shorten procedures and enable faster responses to global energy market dynamics.
A key concern raised by the business community is whether the decision will affect ongoing energy projects. The Ministry of Industry and Trade said projects already approved in principle, under construction, or in operation will not be affected.
The ministry’s rationale is that current projects are implemented mainly based on specific sector plans and investment decisions with the required approvals. These legal bases remain in force and continue to serve as the basis for investment, construction, and operation. Enterprises, it said, can therefore rely on policy stability in the energy sector.
The ministry also noted that even if planning documents change, the main objectives—energy security, sustainable energy development, and the green transition—remain consistent.
Decision 738/QĐ-TTg, signed by the Deputy Prime Minister on April 25, 2026, terminates the effect of Decision 893/QĐ-TTg dated July 26, 2023. Decision 893/QĐ-TTg ceases to be in effect as of February 28, 2026.
The decision aims to synchronize the energy planning framework with Decision 363/QĐ-BCT, approved on February 28, 2026, which adjusts the 2021-2030 energy plan to a 2050 horizon.
Under the revised plan, the scope covers major subsectors including oil and gas, coal, electricity, renewable energy, and new energy, spanning activities from exploration, extraction, production, storage to distribution and use.
The adjustment also reflects a shift in development direction, including alignment with the new socio-economic development strategy; adjustments for administrative territorial changes; integration of energy science and technology advances; acceleration of the green transition and achievement of Net Zero by 2050; and strengthening energy security amid rising demand for electricity, fuels, and industry.
In the coming period, the Ministry of Industry and Trade said it will continue to review and finalize sector plans and related policy mechanisms to meet new development requirements.
“Decision 738/QĐ-TTg, together with Decision 363/QĐ-BCT, demonstrates the government’s commitment to building and harmonizing a modern and coherent energy governance system. This provides a foundation for investors to focus on key energy projects and move the country forward in the new era,” the ministry stated.
