Ministry of Interior is seeking feedback on a draft decree regulating the recruitment, use, and management of civil servants, which is expected to take effect on July 1, 2026. The draft proposes adding new eligible cases for admission to civil service. In line with removing the category of social-level public officials to align with the 2025 Law on Public Employees, the draft adds the groups eligible for civil service recruitment as specialists, scientists, jurists, and outstanding and successful entrepreneurs currently working in agencies, organizations, or units outside the public sector under the talent-attraction policy. According to the Ministry of Interior, adding these groups is consistent with the Civil Servants Law in attracting high-quality human resources and experienced individuals who can meet job requirements immediately upon joining. Thus, after the addition, there will be nine groups eligible for civil service recruitment, as follows: First, specialists, scientists, jurists, lawyers who are outstanding and entrepreneurs who are exceptional and currently working in agencies, organizations, or units outside the public sector under the talent-attraction policy. Second, people with at least five years of service performing professional tasks relevant to the job position to be filled at the agency, organization, or unit established by law, with compulsory social insurance contributions. If there are periods of non-continuous service without a one-off social insurance payment, such periods may be accumulated. Third, people who have previously been civil servants or officials, who were then formally transferred by a competent authority to work at other agencies or organizations, but who still perform tasks relevant to the intended position. Fourth, people with a doctoral degree or higher (recognized by a competent authority) currently working at a foreign-based agency or organization, or at a foreign agency/organization with a presence in Vietnam, whose field of study matches the position and who have at least three years of relevant professional experience. Fifth, people with special talent or aptitude suitable for the position in fields such as culture, arts, sports, or traditional crafts as regulated by relevant professional law. Sixth, people currently under contract to work in a public-service unit. Seventh, members of the project to recruit young intellectuals to rural and mountainous communes during 2013–2020 who are under labor contracts and working in the commune. Eighth, people who were non-professional at the commune level before July 1, 2025. Ninth, other groups as provided by law in their sector or field. The competent recruitment authority or a delegated body will decide admission within its jurisdiction.
