The Ministry of Justice said civil status registration that is not dependent on administrative boundaries can be implemented immediately once the amended Civil Status Law takes effect. The measure is intended to reduce procedures and make it easier for citizens to complete civil status registration.
Some delegates raised concerns that the change could overload areas with large hospitals, where many birth and death registrations must be processed and linked with other administrative procedures. They argued this would increase the workload for civil status officers at the commune level.
In its explanation, the Ministry of Justice said the current conditions and resources needed to implement the boundary-independent civil status registration have been secured.
The Ministry said it has built and put into operation a civil status database under a two-tier local government model and for Vietnamese representative offices abroad. The database currently contains more than 146 million records. Registrations offices have also conducted nationwide data lookups to support administrative procedures that are not limited to a single locality.
On human resources, the Ministry stated that Vietnam has more than 8,000 civil status officers across 3,321 commune-level units, with nearly 90% having undergone professional training. The draft law also requires ongoing review and strengthening of this workforce to meet information technology application requirements.
The Ministry noted that from 1 July 2025, when the two-tier local government model is rolled out, most civil status procedures have been carried out without regard to administrative boundaries. Local authorities reported no surge in the number of filings, including in areas with major maternity and pediatric hospitals.
Based on its assessment, the Ministry of Justice said the rule on civil status registration not dependent on administrative boundaries is feasible and can be implemented as soon as the amended law takes effect, while helping to reduce procedures and facilitate citizens.
According to the schedule, the Civil Status Law amendment project will be voted on by the National Assembly in the second reading of the upcoming session in the near future.
