Vice Chairman of the Ho Chi Minh City People’s Committee, Bui Xuan Cuong, has signed and issued Regulation 19/2026 on the management and use of condominiums in the city. The regulation is intended to improve residents’ quality of life while strengthening transparency and efficiency in managing common assets.
A key highlight of Regulation 19/2026 is the requirement to publicly disclose revenue generated from the common-area portions of condominiums. This includes income from service operations and interest earned from deposits of the maintenance fund.
After deducting reasonable costs, the remaining funds are to be deposited into the maintenance fund account and used to maintain shared ownership areas of the condominiums. The measure is designed to ensure transparency and fairness in asset management and to allow residents to monitor and participate in the process.
The regulation also defines ownership rights to parking spaces within condominiums. Ownership will be determined based on the sale and purchase contract, the lease-purchase agreement, or a separate contract. Contracts between the parties must comply with civil contract provisions, aiming to reduce disputes and protect the interests of all involved parties.
Regulation 19/2026 states that exploitation of the portion of common property in a condominium must be decided by the condominium’s general assembly. The assembly will approve the types of services to be exploited, the location and extent of exploitation, the duration, and the form of exploitation.
The condominium’s management board will implement the decisions based on the approved contents, with the regulation emphasizing openness and transparency.
The People’s Committee of Ho Chi Minh City assigns the Department of Agriculture and Environment to coordinate with the housing management authority to resolve issues related to the Land Use Rights Certificate and ownership of assets attached to the land. The coordination is intended to address difficulties in issuing pink certificates to apartment buyers and other buyers of portions within condominiums.
Regulation 19/2026 is presented as both a legal framework and a commitment by the city government to improve condominium management. By establishing a more transparent and effective mechanism, the regulation is expected to benefit residents and support the development of a civilized, modern living environment as urbanization accelerates.
