Beyond on-the-spot fines or vehicle detention, a range of serious traffic violations can also result in the driver having the vehicle detained on the spot while authorities process the case.
Vehicle detention is frequently applied in situations involving non-compliance with authorities’ instructions or actions that disrupt traffic. Examples include refusing breath or drug tests, failing to follow orders from law enforcement, driving in convoys that impede traffic, using excessive exhaust or repeatedly honking in residential areas, and insulting or defying officers. In these cases, detention may be used to facilitate processing.
Detention can also apply to violations related to vehicle documents and the legal status of the vehicle. This includes driving without registration, using expired documents, or having erased or non-matching chassis or engine numbers. It can also cover vehicles without license plates or with incorrect plates, as well as self-modified or illegally assembled vehicles. Where the origin of legal ownership cannot be proven, the vehicle may even be seized.
Violations involving driving-licence conditions are another common basis for detention during processing. This includes driving without a licence, using an invalid licence, having all points deducted, or being otherwise not suitable for the vehicle type. Detention may also apply when an international driving permit is used without a national licence, or when the vehicle is handed to an unqualified person.
For high-risk actions—such as operating a motorcycle on a highway or engaging in illegal racing—penalties are typically more severe. These cases may include on-the-spot detention aimed at preventing risk.
Vehicle detention is not described as the final penalty. Instead, it is presented as a preventive measure used during the violation-handling process. If the act is serious, involves repeat offending, or concerns an illegitimate vehicle, violators may face heavier consequences such as licence suspension or even seizure of the vehicle.
